We are happy to accept legally aided cases and we will help you to apply. Legal aid is available subject to testing for ‘merit’ and testing for ‘means’.
– Merit
you will qualify for legal aid if the offence you are charged with is serious enough for a prison sentence; or if the case is legally too complicated for you to deal with it; or if you would have particular difficulty in representing yourself eg. because of age, disability or language abilities.
– Means
You will qualify for legal aid in the Magistrates’ Court if your income is low enough. If your yearly income is less than £12,475 you qualify (subject to merit as above).
If your income is greater, you may qualify depending on a further means test, but not if your income is over £22,325.
In the Crown Court, you may qualify for legal aid if you have an income of up to £37,500, although a monthly contribution may be required.
